PUBLIC OFFER AGREEMENT
for the provision of goods and services

Individual entrepreneur Tulinova Yuliia Oleksandrivna, acting on the basis of Extract from the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Formations No. 2 065 000 0000 038548 dated 18.05.2015, hereinafter referred to as the "Seller", publishes this agreement, which is an official public offer addressed to individuals and legal entities, hereinafter referred to as the "Buyer".
1. GENERAL PROVISIONS
1.1. This agreement is a public offer (in accordance with Articles 633, 641 and Chapter 63 of the Civil Code of Ukraine) and contains all the essential conditions for the organization of the sale of paintings and other art goods remotely through the online store https://tulinova.art/.
1.2. When placing an order for goods through the online store, the Buyer unconditionally accepts the terms of this public offer and is considered to have read and agreed to all the terms of the offer.
1.3. The administration of the site https://tulinova.art/ has the right to make changes to this offer, which come into force from the moment of publication on the site. The current version of the agreement is always available on the website.
2. SUBJECT OF THE AGREEMENT
2.1. The Seller undertakes to transfer to the Buyer's ownership the goods specified in the order placed by the Buyer on the online store website, and the Buyer undertakes to pay for and accept the goods under the terms of this Agreement.
2.2. This Agreement regulates the purchase and sale of goods in the online store, including:
- voluntary selection of goods by the Buyer in the online store;
- independent placing of an order by the Buyer in the online store;
- payment by the Buyer for the order placed in the online store;
- processing and delivery of the order to the Buyer in accordance with the terms of this Agreement.
3. ORDERING PROCEDURE
3.1. Ordering of Goods is carried out by the Buyer through the online store https://tulinova.art/.
3.2. When placing an order, the Buyer must provide the following information:
- surname, first name of the Buyer;
- delivery address of the goods;
- contact phone number;
- contact e-mail;
- payment method.
3.3. The information provided by the Buyer is confidential. The Buyer is responsible for the accuracy of the information provided when placing an order.
3.4. The fact of placing an order and paying for the goods is an unquestionable acceptance of the terms of this Agreement.
4. COST AND PAYMENT PROCEDURE
4.1. The cost of each item is indicated on the online store website.
4.2. The cost of goods may be changed by the Seller unilaterally. At the same time, the price for goods ordered by the Buyer cannot be changed by the Seller after accepting the order for execution.
4.3. Payment for the Order is made in UAH in accordance with the exchange rate established by the Seller or in the currency selected when placing the order.
4.4. Methods of payment for goods are indicated on the website of the online store.
4.5. With a non-cash form of payment, a prerequisite is 100% prepayment of the order amount.
5. ORDER DELIVERY
5.1. Delivery of goods purchased in the online store is carried out by courier service or in another way as agreed by the parties.
5.2. Delivery is carried out to the address specified by the Buyer when placing an order.
5.3. Delivery times for goods may vary depending on the delivery address.
5.4. The Seller is not responsible for violation of delivery terms by transport companies or delays in delivery of goods due to postal or courier services.
6. RIGHTS AND OBLIGATIONS OF THE PARTIES
6.1. The Seller is obliged to:
- Transfer to the Buyer goods of proper quality, in accordance with the description on the website, within the agreed time frame;
- Not disclose the Buyer's personal data and not provide access to this information to third parties;
- Provide the Buyer with information about the goods and the conditions for their purchase;
- Consider the Buyer's claims in accordance with the current legislation of Ukraine.
6.2. The Buyer is obliged to:
- Pay for the goods within the time frame and in the manner specified when placing the order;
- Accept the goods within the established time frame;
- Provide reliable information necessary for the fulfillment of the order.
7. LIABILITY OF THE PARTIES
7.1. The parties are responsible for non-fulfillment or improper fulfillment of the terms of this Agreement in the manner prescribed by this Agreement and the current legislation of Ukraine.
7.2. The Seller is not liable for damage caused to the Buyer as a result of improper use of goods purchased in the online store.
7.3. The Seller is not responsible for improper, untimely execution of orders if the Buyer provided inaccurate or incomplete information.
7.4. The parties are released from liability for complete or partial non-fulfillment of their obligations if this was the result of force majeure circumstances.
8. RETURN AND EXCHANGE OF GOODS
8.1. Return and exchange of goods is carried out in accordance with the requirements of the current legislation of Ukraine.
8.2. Return of goods of proper quality is possible within 14 days from the moment of receipt of the goods, if it has not been used, the marketable appearance, consumer properties, seals, labels, etc. have been preserved.
8.3. Return of goods of improper quality is carried out in accordance with the provisions of the Law of Ukraine "On Consumer Protection".
8.4. Refund is made after the Seller receives the goods and checks its condition.
8.5. Refunds shall be made except for the amount of transportation costs, if any, incurred by the seller.
9. CONFIDENTIALITY AND PROTECTION OF PERSONAL DATA
9.1. The Buyer grants permission to process his personal data for the fulfillment of the terms of this Agreement.
9.2. The Seller undertakes not to disclose the information received from the Buyer, not to transfer it to third parties, except in cases when this is necessary to fulfill obligations under the Agreement.
9.3. Transfer of confidential information to third parties can be carried out only in accordance with the current legislation of Ukraine.
10. DISPUTE RESOLUTION PROCEDURE
10.1. All disputes and disagreements that arise when the Parties fulfill their obligations under this Agreement are resolved through negotiations.
10.2. If it is impossible to eliminate them, the Parties have the right to seek judicial protection of their interests in the manner prescribed by the legislation of Ukraine.
11. TERM OF THE AGREEMENT
11.1. This Agreement comes into force from the moment of its acceptance by the Buyer by placing an order on the website of the online store and is valid until the parties fully fulfill their obligations under this Agreement.
